SC Dismisses Meenakshi Natarajan's Plea on RS Nomination Rejection

The Supreme Court on Friday dismissed a plea filed by Congress leader Meenakshi Natarajan challenging the rejection of her nomination papers for the Rajya Sabha election from Madhya Pradesh, while granting her liberty to pursue the matter through an election petition. Three BJP candidates have since been declared elected to the Rajya Sabha from the state. The returning officer had held that her papers were incomplete as they did not mention a pending case in the Telangana High Court
If the court accepts arguments to find out glaring cases which are required to be interfered under Article 32/226, and the other sets of cases, where the rejection is not so improper prima facie to relegate them to election petitions, this court would be reading some principle which is not provided for under Article 329. We are afraid that any such interpretation that in some of the matters this court can interfere while leaving some others to avail the remedy of the election tribunal cannot be encouraged,” it said.
Rejecting submissions made by senior advocate Abhishek Singhvi for the petitioner, the court said accepting such arguments would amount to introducing an exception not envisaged in the constitutional scheme. “To accept the petitioner's submission would amount to reading into the constitutional scheme an exception which has not been provided by the Constitution itself,” it said. The court clarified that its observations were limited to the maintainability of the petition and would not affect the rights of the parties in any election petition filed before the competent High Court.
